My unmarried partner of 17 years left me his $1.1 million home. His three children are livid. Should I share my inheritance?

Dear Annie:

I was in a committed relationship with “Mark” for 17 years. We never married. He recently passed away after a short illness. He left me his home, worth about $1.1 million, in his will. I never paid rent, although I put about $45,000 toward a new kitchen and a roof.

Mark had three children from a previous marriage. They are furious that he left everything to me. They claim I took advantage of their father. They want me to share the inheritance equally among the four of us.

I feel like I deserve the house because I spent so many years with Mark and contributed financially to its upkeep. But I also don’t want to cause further family strife.

What should I do?

—Conflicted

Dear Conflicted:

This is a tough situation. Mark’s will is the legal document that dictates how his assets are distributed. Unless you were legally married, you have no legal obligation to share the inheritance with his children.

However, legal rights don’t always equate to moral rights. You contributed financially to the house, and you shared your life with Mark for 17 years. That’s significant. His children’s anger is understandable; they’ve lost their father and feel excluded from his final wishes.

You have several options:

1. You can stand your ground and keep the house entirely for yourself. Be prepared for continued conflict.

2. You can offer to sell the house and divide the proceeds equally among the four of you. This would resolve the financial issue but would also mean losing your home.

3. You can offer to give the children a portion of the house’s value in cash. This would allow you to keep the house while still acknowledging their claim to some of the inheritance.

4. You can negotiate a compromise. Perhaps you could offer them a life estate in the house, meaning they could live there for the rest of their lives, but you would retain ownership.

Before making any decisions, consult with an estate attorney to understand your legal rights and obligations. Then, have an honest conversation with Mark’s children. Explain your position and listen to theirs. Try to find a solution that respects everyone’s feelings and minimizes further conflict.
